• You are responsible for ensuring that your test content does not infringe on any third-party intellectual property rights

You may not modify, reproduce, distribute, create derivative works of, publicly display, or perform any of our platform's proprietary elements without our prior written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Free Test Maker and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the platform
• Any conduct or content of any third party on the platform
• Any content obtained from the platform
• Errors or inaccuracies in test content or results
• Unauthorized access, use, or alteration of your content or account
• Technical issues that may affect test creation or administration

9. Disclaimer of Warranties

Free Test Maker and its services are provided on an "as is" and "as available" basis without any warranties of any kind. We do not warrant that:

• The platform will be uninterrupted, timely, secure, or error-free
• Tests created or administered through our platform will be free from errors
• The results obtained from the use of the platform will be accurate or reliable
• Any errors in the platform will be corrected

10. Indemnification

11. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination:

• Your right to use the platform will immediately cease
• You may request a copy of your test content within 30 days
• After 30 days, we may delete your content from our active servers

If you wish to terminate your account, you may do so through your account settings or by contacting our support team.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

All disputes arising out of or in connection with the use of Free Test Maker shall be resolved exclusively through the courts in Kota Judicial jurisdiction, Rajasthan, India. By using this platform, you agree to submit to the jurisdiction of these courts for the resolution of any disputes.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the platform.
